Seems it may be that Special Prosecutor Angela Corey could be skating on very thin ice regarding the affadavit she’s laid out against George Zimmerman in the 2nd Degree Murder Charge she has against him. I’ve heard the same from a handful of others in the legal-know today as well, including radio talk show host Mark Levin. During his show when he went through it step-by-step, saying he couldn’t see how this would go anywhere whatsoever. But we’ll stick with this one because Dershowitz lays it out clean and simple for all to understand.

Harvard University law professor Alan Dershowitz appeared on MSNBC’s Hardball where fill-in host Michel Smerconish asked him his opinions of the arrest warrant issued and carried out for alleged Trayvon Martin murderer, George Zimmerman. Dershowitz called the affidavit justifying Zimmerman’s arrest “not only thin, it’s irresponsible.” He went on to criticize the decision to charge Zimmerman for second degree murder by special prosecutor Angela Cory as being politically motivated.

“You’ve seen the affidavit of probable cause. What do you make of it,” Smerconish asked. “It won’t suffice,” Dershowitz replied without hesitation.

“Most affidavits of probable cause are very thin. This is so thin that it won’t make it past a judge on a second degree murder charge,” Dershowitz said. “There’s simply nothing in there that would justify second degree murder.”

Dershowitz said that the elements that would constitute that crime are non-existent in the affidavit. “It’s not only thin, it’s irresponsible,” said Dershowitz.

Dershowitz went on to strongly criticize Cory’s decision to move forward with the case against Zimmerman. “I think what you have here is an elected public official who made a campaign speech last night for reelection when she gave her presentation and overcharged. This case will not – if the evidence is no stronger than what appears in the probable cause affidavit – this case will result in an acquittal.”

Smerconish identified the total lack of any mention of the supposed fight that occurred between Martin and Zimmerman prior to Martin being shot. He said he was disappointed that he did not see any mention of that conflict that led to Martin’s murder.

“But it’s worse than that,” said Dershowitz. “It’s irresponsible and unethical in not including material that favors the defendant.”

“This affidavit does not even make it to probable cause,” Dershowitz concluded. “everything in the affidavit is completely consistent with a defense of self-defense. Everything.”

Plus, this happened today as well with Trayvon Martin’s mother during an interview…which she had to call back and correct within hours because of screeching from many behind the scenes dontcha know. She stated her son’s death was most likely an accident, heck…I heard it via radio talk-news as a headline for two hours until she changed her story. ‘You Read, You Watch, You Decide‘ what story you really believe at this stage of the game.

The mother of Trayvon Martin has clarified remarks that her son’s shooting death was an “accident,” saying she meant Martin’s encounter with George Zimmerman, not Zimmerman shooting him.

I believe it was an accident. I believe that it just got out of control and he couldn’t turn the clock back,” Sybrina Fulton said Thursday on NBC’s “Today.”

The comment immediately drew widespread attention, prompting Fulton to release a statement to NBC saying her remark had been “mischaracterized” and that she believes “George Zimmerman stalked my son and murdered him in cold blood.”

“The ‘accident’ I was referring to was the fact that George Zimmerman and my son ever crossed paths,” Fulton said. “It was an accidental encounter. If George Zimmerman hadn’t gotten out of his vehicle, this entire incident would have been avoided.”

Zimmerman was charged Wednesday with second-degree murder in the unarmed Florida teen’s death. Zimmerman has maintained he shot Martin in self-defense.

Earlier today, I made a comment to the media that was later mischaracterized. When I referenced the word ‘accident’ today with regard to Trayvon’s death, in NO way did I mean the shooting was an accident.

We believe that George Zimmerman stalked my son and murdered him in cold blood. The ‘accident’ I was referring to was the fact that George Zimmerman and my son ever crossed paths. It was an accidental encounter. If George Zimmerman hadn’t gotten out of his vehicle, this entire incident would have been avoided.

My son was profiled, followed and murdered by George Zimmerman, and there was nothing accidental about that.

    I don’t put it beyond them fabricating ‘evidence’ and ‘witnesses’ to railroad Zimmerman…. Luckily, he has a good, smart and tenacious lawyer…

    Notice that in all this, there is NO mention of action against the New Black Panthers who issued a bounty for the murder of Zimmerman—or any investigation regarding the manipulated ‘evidence’ by ABC & NBC.

    I sincerely hope that the facts show that Zimmerman did NOT commit a crime and sues anyone he can from—NBC, Spike Lee, the New Black Panthers—and Holder to the point that they are bankrupted–and Zimmerman is a multi, multi millionaire…

He says, (paraphrasing) that he thinks because of political/msm pressure yada yada, that no judge will throw it out…will go to jury to please the masses and threats etc.

    As far as Martin’s mother’s little slip. Even her correction doesn’t make any sense. She says that the “accident” to which she was referring was the meeting between the two men (that’s right, I said “two men”).

    If Zimmerman “stalked [her] son and murdered him in cold blood”, how could the meeting have been an accidental event and why would Zimmerman would like to “turn the clock back” on it?? According ot them, he did it intentionally, so wouldn’t he just do it again??

  13. I was misinformed, I thought that Zimmerman was a Cuban Hispanic. But I see that he may actually be a “Mestizo”, anyway, he is (and I will say this Loudly for the idiots to read) NOT CAUCASIAN!         Your right, of course. The SYG laws have got to be the only REAL reason that they are going forward with this. We know that these scumbags don’t really give a rat’s ass about this punk’s death, except to use it to further their political agenda. But the word is that they want to do this via claiming that Zimmerman “profiled” the punk. This means that they are going to have to prove that Zimmerman was out actively looking for a black man to start an altercation with and shoot, planning on using SYG as his defense. Just how this can be proven is a mystery, this was a chance encounter. All eyewitmesses so far have corroborated Zimmeran’s account of what occurred. Short of possible phony witnesses and fabricated evidence, they have nothing.

The orders have come down from the Yomamma administration via Eric the Assinine. There is no way this indictment is founded on facts or evidence. This man is simply a political prisoner at this point.
            I still believe that many minorities other than blacks are going to view this as evidence that anyone is to be sacrificed by this administration in order for them to further their liberal agenda.     Special prosecutor Angela Corey has done a great job. She knew that she could not get 1st degree so she threw out a grand jury. She made the decision to charge 2nd degree, which is brilliant. You do that to get a easy manslaughter conviction. Zimmerman is a small fish in a big pond. We have to stop racial profiling and eradicate stand your ground. I own many guns (legally) and often carry them. But stand your ground is vigilantism and not needed.

    I do think Dershowitz is correct – the affidavit is sloppy, opinionated, and at least partially fictitious.

    I’d like to address a related aspect of this travesty: we’re playing into the liberal narrative by letting them frame this as a black vs. white and liberal vs. conservative debate. We’d be a lot smarter to stop quibbling about George Zimmerman’s ethnicity and insist he’s simply an American, with all the rights a legal citizen is entitled to. Let the liberals keep playing their race card since the more it’s used the less effective it becomes.

    Conservatives should be putting 100% support behind the justice system and NOT behind George Zimmerman. We have no business supporting anything but the truth, and let the chips fall where they may. Leave the opinions of guilt and innocence to the racists; their bigoted statements will be used against them for years to come.

    One other thing to remember is that George Zimmerman is a registered democrat. He may make public statements that rub Conservatives the wrong way, especially people who have an emotional investment in this trial. Any anti-Zimmerman rhetoric by the right will be broadcast far and wide by the mainstream media; again, it’s far better to support truth and justice instead of publicly choosing a side in a court battle.

    For the record, I do have a developing opinion about what happened the night Martin was shot, but I also realize the media has at least partially controlled the message and not all the facts are available. Perhaps more importantly, my opinion doesn’t matter. That’s why we have courts and judges and lawyers and appeals, instead of letting the masses vote for guilt or innocence like it’s a Dancing With The Stars episode.

    2nd degree murder charge, no grand jury, selective affidavit filed equals
    Charges dismissed at initial trial hearing by almost any judge in Florida.

    Proof of a scuffle, whom ever initiated, and stand your ground law is
    Acceptable and constitutional, there are a number of state cases that
    Are precedents, period.

    The question for me is; what will happen when he is acquitted of all charges?

    Has there been enough time for the entire country to understand this in a rational manner.

      The law is supposed to depend only upon the facts, step by step- what exactly happened, who did what, and in what order. Like you stated, exactly what did Zimmerman do that was illegal? People like the thug’s mother want the law to depend upon emotion- naturally she (as the thug’s mother) is going to want it that way, but the law is supposed to be blind and indifferent to such things.
