Dudes and Dudettes…it seems this opinion writer for the NYT’s has a deep-seething hatred for our Constitution. One things a sure fact, Louis Michael Seidman fits right in with the NYT Slime Machine.

Here’s the report. – This is via Mediaite:

Georgetown University constitutional law professor Louis Michael Seidman has just about had it with the focus of his 40 years of academic study. As he writes in the New York Times on Monday, it is the Constitution itself which has allowed for the series of legislative follies that finally resulted in the “fiscal cliff.” Seidman says that it is time for Americans to realize what lawmakers have known since the constitution’s inception – it is okay to ignore it.

“As the nation teeters at the edge of fiscal chaos, observers are reaching the conclusion that the American system of government is broken. But almost no one blames the culprit: our insistence on obedience to the Constitution, with all its archaic, idiosyncratic and downrght evil provisions,” Seidman writes.

Our obsession with the Constitution has saddled us with a dysfunctional political system, kept us from debating the merits of divisive issues and inflamed our public discourse. Instead of arguing about what is to be done, we argue about what James Madison might have wanted done 225 years ago.

He goes on to detail the number of American politicians who have used every opportunity to sideline the Constitution; from John Adams to Abraham Lincoln to Franklin Delano Roosevelt.

“In the face of this long history of disobedience, it is hard to take seriously the claim by the Constitution’s defenders that we would be reduced to a Hobbesian state of nature if we asserted our freedom from this ancient text,” Seidman adds.

He says that the freedoms enshrined in the Bill of Rights are time-tested and should be preserved, but the system of established powers. Seidman says that there is a real threat that American dysfunctional governance could rend the republic sunder, and it is far more preferable that the Constitution be junked than the Union.

Seidman concludes that, though Americans will probably not give up on Constitution any time soon, his recommendation is the best of a series of bad choices facing the nation:

If even this change is impossible, perhaps the dream of a country ruled by “We the people” is impossibly utopian. If so, we have to give up on the claim that we are a self-governing people who can settle our disagreements through mature and tolerant debate. But before abandoning our heritage of self-government, we ought to try extricating ourselves from constitutional bondage so that we can give real freedom a chance.

  1. He forgot to mention GWB in that list. The fourth amendment is summarily trampled upon through the machinations of the Patriot Act. The learned professor is wont to say that issues cannot be debated in a rational and adult manner by the politicians. That is half true. When the Left is left with no recourse, on being challenged on their ideology, they resort to name calling, and violence.

    He wants to dispose of the Constitution, but what then would he put in it’s place? The problem is not the Founding Principles, but rather the ever spiraling deficit, and moral decay of the nation.

    They can always point out what is wrong, in their opinion, but they never have a plausible solution.

    The Framers knew the danger of fiat money from a printing press, they had just seen the first US dollar become ‘not worth a Continental’ due to overprinting and the inflation that resulted.
    It is the unConstitutional creation of the Privately owned Federal Reserve banking system that allows our government to unlawfully burden the future with unpayable debt, and create this ‘fiscal cliff’ in the first place.

We will see even more of this brazen and ‘in your face’ attitude among liberals. They know they got the GOP on the run and they are looking to finish off the liberal ‘snowball’ effect that started to roll last November. It was indeed written by wealthy white landowners, and it stands on the bedrock of private property and English common law. It is everything that marxism loathes, and it all we have left of the genius of the founders. The Left has been at war with the Constitution since 1860, and they will not be satisfied until it has been sucked dry of any meaning or power. Both Ruth Bader Ginsberg and Barack Obama (a self-identified”constitutional scholar”) have criticized the Constitution as obsolete and insufficiently marxist. Democrats read the Constitution the way that tax lawyers read the tax code.
