Judge Napolitano posted a piece yesterday I wanted to share with all of you today. What he states is more than important to this country, now more than ever…especially with those that hold power over us, and we all know who they are. This is somewhat lengthy, so I’m cutting directly to the chase.

Do you have more personal liberty today than on the Fourth of July 2012?

When Thomas Jefferson wrote the Declaration of Independence, he used language that has become iconic.

He wrote that we are endowed by our Creator with certain inalienable rights, and among them are life, liberty and the pursuit of happiness.

Not only did he write those words, but the first Congress adopted them unanimously, and they are still the law of the land today.

By acknowledging that our rights are inalienable, Jefferson’s words and the first federal statute recognize that our rights come from our humanity — from within us — and not from the government.

Today we have a government that alone decides how much wealth we can retain, how much free expression we can exercise, how much privacy we can enjoy.

The government the Framers gave us was not one that had the power and ability to decide how much freedom each of us should have, but rather one in which we individually and then collectively decided how much power the government should have. That, of course, is also recognized in the Declaration, wherein Jefferson wrote that the government derives its powers from the consent of the governed.

To what governmental powers may the governed morally consent in a free society? We can consent to the powers necessary to protect us from force and fraud, and to the means of revenue to pay for a government to exercise those powers. But no one can consent to the diminution of anyone else’s natural rights, because, as Jefferson wrote and the Congress enacted, they are inalienable.

Just as I cannot morally consent to give the government the power to take your freedom of speech or travel or privacy, you cannot consent to give the government the power to take mine.

This is the principle of the natural law: We all have areas of human behavior in which each of us is sovereign and for the exercise of which we do not need the government’s permission. Those areas are immune from government interference.

That is at least the theory of the Declaration of Independence, and that is the basis for our 237-year-old American experiment in limited government, and it is the system to which everyone who works for the government today pledges fidelity.

Regrettably, today we have the opposite of what the Framers gave us. Today we have a government that alone decides how much wealth we can retain, how much free expression we can exercise, how much privacy we can enjoy. And since the Fourth of July 2012, freedom has been diminished.

In the past year, all branches of the federal government have combined to diminish personal freedoms, in obvious and in subtle ways.

In the case of privacy, we now know that the federal government has the ability to read all of our texts and emails and listen to all of our telephone calls — mobile and landline — and can do so without complying with the Constitution’s requirements for a search warrant.

We now know that President Obama authorized this, federal judges signed off on this, and select members of Congress knew of this, but all were sworn to secrecy, and so none could discuss it. And we only learned of this because a young former spy risked his life, liberty and property to reveal it.

In the past year, Obama admitted that he ordered the CIA in Virginia to use a drone to kill two Americans in Yemen, one of whom was a 16-year-old boy. He did so because the boy’s father, who was with him at the time of the murders, was encouraging militants to wage war against the U.S.

He wasn’t waging war, according to the president; he was encouraging it.

Simultaneously with this, the president claimed he can use a drone to kill whomever he wants, so long as the person is posing an active threat to the U.S., is difficult to arrest and fits within guidelines that the president himself has secretly written to govern himself.

In the past year, the Supreme Court has ruled that if you are in police custody and fail to assert your right to remain silent, the police at the time of trial can ask the jury to infer that you are guilty. This may seem like a technical ruling about who can say what to whom in a courtroom, but it is in truth a radical break from the past.

Everyone knows that we all have the natural and constitutionally guaranteed right to silence. And anyone in the legal community knows that judges for generations have told jurors that they may construe nothing with respect to guilt or innocence from the exercise of that right.

No longer. Today, you remain silent at your peril.

In the past year, the same Supreme Court has ruled that not only can you be punished for silence, but you can literally be forced to open your mouth. The court held that upon arrest — not conviction, but arrest — the police can force you to open your mouth so they can swab the inside of it and gather DNA material from you.

Put aside the legal truism that an arrest is evidence of nothing and can and does come about for flimsy reasons; DNA is the gateway to personal data about us all. Its involuntary extraction has been insulated by the Fourth Amendment’s requirements of relevance and probable cause of crime.

No longer. Today, if you cross the street outside of a crosswalk, get ready to open your mouth for the police.

The litany of the loss of freedom is sad and unconstitutional and irreversible. The government does whatever it can to retain its power, and it continues so long as it can get away with it. It can listen to your phone calls, read your emails, seize your DNA and challenge your silence, all in violation of the Constitution.

Bitterly and ironically, the government Jefferson wrought is proving the accuracy of Jefferson’s prediction that in the long march of history, government grows and liberty shrinks. Somewhere Jefferson is weeping.

          My guess is that you will see our country continue to spiral downward under Obummer… don’t forget, we still have another 3 1/2 years left under this puke and his administration. Will we the people take to the streets in protest before his term is up or will we just be happy to have our morning coffee and watch American Idol???

          I realize not everyone can stop what they are doing and travel to DC to protest… but I am in hopes that we will soon see demonstrations in our cities across America protesting this socialist puke of a president along with his administration.

          Obummer is nothing short of a lazy black man who apparently arrives the oval office around 11:00 AM when not playing golf or flying across the country to speak with minds of mush in colleges and high schools. This president can not open his mouth without lying… I’m fed up with his arrogance and his dividing of our country. Unless history is spun for Obummer, he will rank twenty spots below Jimmy Carter.

            I couldn’t agree more. This isn’t the country I grew up in, or served 20 years of my life for, or served in Iraq and Afghanistan for, or even promised my kids. I said in another post that I wondered what would it take to break the camel’s back. 3 1/2 years more of this continuing trend of decay and decline just might do it.

            I read all of your post and can tell you are well educated and a loyal patriot. So I naturally give weight to your opinions and thoughts. I can not possibly travel to DC to protest. Nor do I think a single protest in a line of endless protests will make much difference. However, if every city held a protest, even a small one, the cumulative numbers would be significant enough to warrant attention.

            I wished I were an eternal optimist, but I’m not. Military training taught me to hope for the best but prepare for the worst. I’ve been preparing for an economic meltdown for two years and still don’t feel prepared. What I never expected was the possibility of a tyrannical government such as we see today. I thought I had just lost touch with mainstream America. That is until I found this website. Now I know I’m not alone.

            I was in Ballad Iraq eating in the chow hall surrounded by several hundred armed soldiers, marines, sailors, and airmen when President Osama declared the last of our combat troops had departed Iraq. I almost choked on my food. I remember thinking, Who the hell are all these people then?

            When that base closed and we were transferred to Al-Asad in Iraq, plans were well under way to expand and grow the base when the word came in that we had 30 days to leave the country because the SOFA agreement had fallen through. But I am here to tell you as an eye witness who was there at the time, until that moment we had no intentions leaving. What a logistical nightmare that was. I then later seen Pres Osama claiming he kept his promise of leaving Iraq. Hogwash!!! We were forced out for our own safety.

            We simply transferred our assets to Kandahar Afghanistan where I lived and worked till April of this year. We soon will be leaving there as well from what I’m seeing. More sooner than later. Despite being somewhat deprived of news overseas, it was clear that Ovomit was/is a pathological liar.

            During those 4 combined years between the three bases, with mortars a regular event in Iraq and rockets the norm in Afghanistan, I had less concern then than I do now. There is nothing like being gone for 4 years and then re-assimilating back into America culture to open your eyes to any changes that occurred while you were gone. But I’m more concerned now than I ever was downrange. And I haven’t a clue what to do about it.

            If I were in a position to protest, in any city in any state, I would gladly do so. But I’m not. For now at least, I will have to depend on others to do the protesting for me.

            I apologize for being so long winded this week. I come from a long line of military family members and the 4th of July means more to me than just fireworks as I’m sure it does to many readers here.

            I know you weren’t talking to me, but my friend…I am eternally grateful to you, the wise knowledge you share with us via your experience of being there and done that…along with your concern and worry about this country’s future, specifically with the evil we have hoovering over us every step of the way…that being Barack Hussein Obama and his minions that obey willingly.

            I’m tired at the end of the week, tomorrow is another day…and fight on we must, each of us in our own individual ways, but yet together we are and together we will stand when and if the time comes.

            From a vet, let me thank you for your service… yes I am very much a patriot, but I certainly can not express myself like AWD… I think I was looking at short skirts on the day we were learning good writing skills in school.

            I too read your post and can tell you love the USA…you mentioned you were still out of country in April of this year… are you still actively serving overseas now???

            I’m glad you found this site of like minded individuals… I take my hat off to AWD and the other regulars who post here as I know they have love of country first and foremost.

Had people been paying attention and getting off their asses to do something about it, we might not be in this bad a shape.. Speaking up at every bonehead thing any politician does is just the start, Hopefully it’s not too late and many more do get involved before we lose the Republic to these asshats..       July 4th is celebrated in honor of the day we tossed off the chains of tyranny from a dictatorial government. I think it’s time we reminded Congress that the calendar contains plenty of empty days in which to add another holiday.

      I don’t know what it’s going to take to break the camel’s back, but I feel we are close. In my 50+ years of living I have seen Patriotic pride both wax and wane dramatically under different Presidents. (Remember Carter? Then Reagan? What a change.) But I have never before seen such animosity against the government by so many people from different walks of life and socio-economic status as I’m seeing now. And it scares me.

      I know I’m not the sharpest bullet in the ammo box, but I’m smart enough to observe, watch, listen, and conclude a logical thought. And I have formed an opinion on the current administration that may seem extreme, but it so fits the pattern of behavior we are observing and I’d like to share it with you and see if anyone agrees, or if I am over thinking the issue.

      When I think of organized crime, two cities immediately come to my mind, Chicago and New York. Right now there is a major rift between Clinton and Obama. Hillary was planning on writing a scathing book against Obama until she was offered Sec. of State. She is writing that book now and no doubt will run for election in 2016. I think the reason they despise each other is clearly because they come from two different power bases. One from Chicago, and one from New York.

      The Chicago power base is about to lose it’s power after 2016 and finding another libtard like Obama that can be trusted is hard to come by. Mean while the New York power base wants in position, especially with the recent trampling of the constitution which allows any president to spy on anyone, anywhere, and kill them or use the full force of the government against them in whatever fashion suits the purpose. These two power bases are at war.

      There is only one way Obama can remain in power after 2016, and that would be the declaration of Martial Law in a national emergency. I think the bankruptcy of America would fit that bill, along with race riots, food riots, and confiscation riots. In 1933 the gov. confiscated gold and silver to pay for an economic meltdown. I fear we may see that again. But this time, it would not be nearly as easy. Too many guns, and not enough tracking of gold/silver purchases.

      Since Obama’s election he has been fabricating crisis after crisis to disarm us. Why else would he have instituted the gun trade with Mexico? No other reason. Also, are you aware that Illinois has passed laws requiring you to register physical possession of your gold and silver? They say it’s so they can help recover from theft and generate income for the state. Does that make sense to you? Doesn’t to me.

      And what would a dictator need if he couldn’t fully trust his own army? Mercenaries of course. Can you say Russian soldier? If I wanted to set myself up as dictator of a country, the first things I would do is disarm as many people as possible, seize the gold and silver, hire a private army, spy on everyone with every possible means available to me, and fabricate a national emergency.

      Any of this sound familiar? You can call me a kook, I don’t care. And I hope I’m wrong. No, I Pray I’m wrong. But I see the dominoes falling and it ain’t looking good.

      I guess my question is this. Am I the only one seeing this? Am I being paranoid? Or am I over-reacting?

Things in this country are now like they were 237 years ago during our American revolution, where we resisted and toppled an oppressive, anti-inalienable(God given) human rights government. Bill of Rights 1,2,4 and 10 are now being violated. Jefferson would grieve, then recover, then lock and load, then fire at will.

  14. There is a reason our Bill of Rights come as amendments. That is to say, it was excluded in the original version of 1787 Constitution. Madison, Hamilton et al. thought that a Bill of Rights was “unnecessary”.

    Anti-Federalists like JEFFERSON, Henry, and Yates OPPOSED ratification of 1787 Constitution. They believed it would “annihilate” state governments (as Hamilton wanted). They believed it provided for the total consolidation of power into a central government, run by a military king. They believed 1787 U.S. Constitution was a THREAT to FREEDOM, LIBERTY, and JUSTICE for all.

    There is a reason our Bill of Rights was the first act of Congress. Once it became obvious that ratification of 1787 Constitution was unavoidable, Anti-Federalists made it their mission to have a Bill of Rights included, in order to make better of a bad situation. They and they alone are to be thanked. But let’s not lump them in with “The Framers”. The Framers left Philadelphia having written their document, void of a Bill of Rights. It was “unnecessary”.

    The weaknesses and shortcomings of These United States’ first constitution were over-exaggerated. The states confederated and entered into Perpetual Union in 1777, and only ten years later it was ripped away by “stock jobbers and king-jobbers”. If you want states’ rights, little central authority, and Liberty, then I have no idea why you promote 1787 U.S. Constitution. JEFFERSON certainly did not. 1787 Constitution is consolidation, it’s corporate power, it’s bureaucracy, it’s Aristocracy, it’s annihilation of the states. 1787 Constitution is Hamilton, not Jefferson.
